PRIVACY POLICY

Bunker Birdie LLC (“Bunker Birdie,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, and disclose personal information when you visit our website, reserve a simulator bay, contact us, sign up for our programs, or visit our venue.

1. Information We Collect

Depending on how you interact with us, we may collect:

- Contact information, including your name, email address, phone number, and billing address.

- Reservation and purchase information, including booking times, services purchased, transaction details, and participation in memberships, leagues, tournaments, or events.

- Communications, including inquiries, customer-service messages, feedback, and communication preferences.

- Consent records, including your acceptance of applicable terms and your choices regarding text messages, marketing, and photography.

- Website information, including your IP address, browser type, device information, pages visited, and interactions with our website.

- Video surveillance footage, where security cameras are installed and operating.

Payment information is handled through our payment providers. We do not independently store full payment-card numbers on our website.

Payment providers may securely retain payment credentials when you authorize a card to secure a reservation or make recurring payments.

2. How We Use Information

We use personal information to:

- Manage reservations, payments, memberships, and event registrations.

- Provide booking confirmations, reminders, and service updates.

- Respond to questions and provide customer support.

- Send promotions and other marketing communications consistent with your communication choices and applicable law.

- Improve our website, services, and customer experience.

- Maintain safety, investigate incidents, prevent fraud, and protect our property.

- Maintain business records and comply with legal obligations.

3. Service Providers and Other Disclosures

We use service providers to support our operations. These may include Square for reservations and payments, GoHighLevel for website forms and customer communications, Trackman for golf-related services, and providers of hosting, security, analytics, and advertising services.

We may disclose information to these providers as needed for the services they perform. Their handling of information may also be subject to their own privacy policies.

We may also disclose information when reasonably necessary to comply with law, respond to lawful requests, protect rights or safety, investigate misconduct, or complete a business transfer such as a merger or sale.

We do not sell or rent customer contact lists.

4. Cookies, Analytics, and Advertising

Our website may use cookies and similar technologies to support website functionality, remember preferences, understand website activity, and measure marketing effectiveness.

If enabled, tools such as Google Analytics, Meta Pixel, and Google Ads tracking may collect device information, website interactions, and identifiers. These providers may process information under their own privacy policies.

You can manage cookies through your browser settings and, where available, through controls provided on our website or by the relevant provider. Blocking certain cookies may affect website functionality.

5. Text Messages

With your consent, Bunker Birdie may send text messages about reservations, reminders, service updates, or promotional offers. Consent for promotional texts is collected separately from consent for booking and service texts. Agreeing to receive text messages is not a condition of purchase.

Message frequency varies. Message and data rates may apply.

Reply STOP to unsubscribe from the text-message program. Reply HELP for assistance, or contact us at [email protected] or (208) 981-8158.

We do not share mobile information or text-message opt-in data and consent with third parties or affiliates for their own marketing or promotional purposes. We may provide this information to service providers that help deliver and support our messaging program.

6. Email Communications

We may send emails relating to your reservations, purchases, inquiries, or participation in our programs. We may also send promotional emails consistent with applicable law and your preferences.

You can unsubscribe from promotional emails using the unsubscribe link in those messages. Unsubscribing from marketing does not prevent necessary communications about an existing reservation, purchase, or account.

7. Security Cameras

Our venue may use security cameras in designated areas for safety, security, loss prevention, and incident investigation. Cameras are not placed in restrooms.

Footage may be accessed by authorized personnel and relevant service providers. It may be disclosed when reasonably necessary to investigate an incident, support an insurance claim, comply with law, or protect rights and safety.

Security footage is not used as promotional content without appropriate permission.

8. Marketing Photos and Videos

We obtain affirmative permission before using identifiable customer photos or videos in our marketing, advertising, social media, or website content. Attendance at our venue does not, by itself, grant that permission.

Customers may decline participation without affecting access to our services. For anyone under 18, permission must come from a parent or legal guardian.

If you previously provided permission and wish to withdraw it for future use, contact us. We will discuss reasonable steps regarding content we control; we cannot guarantee removal of printed materials already distributed or copies shared by others.

9. Children’s Information

Our online booking forms are intended for guests age 16 and older making reservations, and adults arranging services for younger guests. We do not knowingly collect personal information online directly from children under 13.

Parents or guardians should provide any information needed to arrange a child’s participation. If you believe a child under 13 submitted personal information directly to us online, contact us so we can review and address it.

10. Retention and Security

We retain information for as long as reasonably needed for the purposes described in this policy, including providing services, maintaining records, resolving disputes, and meeting legal obligations.

We use reasonable safeguards to protect personal information. No electronic system or transmission method is completely secure.

11. Your Choices and Requests

You may contact us to request access to, correction of, or deletion of personal information we hold about you. We will respond as required by applicable law and may need to verify your identity.

Certain records may need to be retained for legal, accounting, security, or other legitimate business purposes.

12. Third-Party Websites

Our website may link to third-party websites or booking platforms. Their privacy practices are governed by their own policies. Review those policies when using their services.

13. Policy Updates

We may update this Privacy Policy as our operations or legal requirements change. The revised policy will be posted on this page with an updated effective date. Additional notice will be provided where required.

Terms and Conditions

These Terms & Conditions apply to website use, simulator reservations, and general venue services provided by Bunker Birdie LLC (“Bunker Birdie,” “we,” “us,” or “our”).

Specific memberships, leagues, tournaments, packages, and private events may have additional terms presented before purchase or registration.

1. Reservations and Payment

Simulator reservations are currently made through Square. A valid payment card is required to secure an online reservation.

Unless otherwise stated when purchasing or booking, payment for simulator time and additional food, beverages, or services is collected at the end of your visit.

By accepting these terms when booking and providing a payment card, you authorize Bunker Birdie to charge applicable cancellation, late-rescheduling, or no-show fees described below. This authorization does not permit unrelated charges.

Prices and applicable taxes are disclosed through our pricing, booking, or checkout process.

2. Cancellations and Rescheduling

Please cancel or request a reservation change at least two hours before the scheduled start time.

Cancellations or rescheduling requests made less than two hours before the scheduled start time may incur a $20 fee per reserved bay.

Bunker Birdie may waive this fee based on individual circumstances. A waiver on one occasion does not guarantee a waiver for future reservations.

3. Late Arrivals and No-Shows

Your reservation begins and ends at the originally scheduled times. Arriving late does not change those times or reduce the charge for the reserved session.

If you have not arrived or contacted us within 15 minutes after your scheduled start time, we may release the bay and treat the reservation as a no-show.

No-shows are subject to a $20 fee per reserved bay.

If you contact us about a delay, we will discuss whether the reservation can still be accommodated. Contacting us does not extend the scheduled session.

4. Cancellations by Bunker Birdie

If we cancel a reservation because of equipment failure, closure, or another operational issue, you may choose to reschedule or receive a refund for prepaid services that were not provided.

5. Memberships, Leagues, Tournaments, and Private Events

Membership pricing, recurring billing, included simulator time, guest privileges, rollover rules, and cancellation requirements are governed by the separate membership agreement presented at signup.

Leagues, tournaments, private events, and promotional packages may have their own booking, payment, cancellation, eligibility, and redemption terms.

Where specific terms conflict with these general terms, the specific terms govern that membership, event, or offer.

6. Children and Responsible Adults

Guests under 16 must have a parent remain onsite during their visit and cannot make their own reservations. Guests age 16 and older may book and attend alone. An adult must sign the applicable agreement for every participant under 18 before participation.

The responsible adult must remain available and provide supervision appropriate to the child’s age, behavior, and activity. Staff may require closer supervision when needed for safety or to prevent disruption.

7. Safe Use and Customer Conduct

Customers must follow staff instructions and use simulator bays, clubs, screens, and other equipment appropriately.

Only the person taking a shot should be within the designated hitting area. Other guests must remain clear of the golfer’s swing and follow posted safety instructions.

Throwing clubs, striking equipment intentionally, reckless behavior, harassment, and other unsafe or disruptive conduct are prohibited. Bunker Birdie may stop an activity or require a person to leave when necessary to protect guests, staff, or property.

8. Equipment and Property Damage

Customers are responsible for damage they cause through misuse, reckless conduct, intentional acts, or failure to follow safety instructions.

Bunker Birdie does not charge customers for ordinary wear or accidental equipment failure during normal, appropriate use.

Where applicable, Bunker Birdie may seek reasonable repair or replacement costs for damage caused by prohibited conduct. This provision does not authorize automatic damage charges to a reservation card without a separate valid authorization or other lawful basis.

9. Outside Food and Beverages

Outside food and beverages are not permitted.

For a disability-related accommodation or other legally protected need, contact us so we can discuss appropriate arrangements.

10. Alcohol Service

Alcohol is available only to guests who are at least 21 and present valid identification when requested.

Bunker Birdie may refuse or discontinue alcohol service where required by law or appropriate for guest safety.

11. Customer Photography and Video

We obtain affirmative permission before using identifiable customer photos or videos for marketing, advertising, social media, or website content.

You may decline without affecting access to our services. Attendance or failure to opt out does not constitute permission.

For customers under 18, permission must come from a parent or legal guardian.

12. Text and Email Communications

Customers may separately choose to receive booking and service texts or promotional texts from Bunker Birdie. Text-message consent is optional and is not a condition of purchase.

Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for assistance. You may also contact [email protected] or (208) 981-8158.

Carriers are not liable for delayed or undelivered messages. You remain responsible for your reservation even if a reminder is delayed or not received.

Promotional emails include an unsubscribe option. Necessary service-related communications may still be sent.

13. Privacy

Our collection and use of personal information are described in our Privacy Policy.

14. Website Content

Website text, branding, graphics, and other content owned by Bunker Birdie may not be copied or used commercially without permission, except where permitted by law.

We aim to keep website information accurate. If a material pricing or booking error is discovered, we will contact affected customers to resolve it before proceeding.

15. Changes to These Terms

We may update these terms and post the revised version with an updated effective date.

Updates do not retroactively change an existing reservation or signed agreement unless agreed to or otherwise permitted by law. The terms presented and accepted for a transaction govern that transaction.

16. Governing Law

These terms are governed by applicable Idaho law and federal law. Nothing in these terms limits rights or protections that cannot lawfully be waived.
